These are the terms of service for the the Spock McCoy Fan Fiction Archive website, here after referred to as The Archive.
  1. Acceptance of Terms
    1. By using and/or visiting The Archive, you agree to these terms.
    2. You agree that you are either of the age of majority in your locality, or that you are an emancipated minor, or that you have express consent from your parent or legal guardian to access The Archive, and that you are fully competent and able to enter into the terms presented herein. You affirm that you are over the age of 13, as this website is not intended for use by those under the age of 13.
    3. We may update these terms at any time, and will make every effort to notify users when updates are made.

  2. External Links
    1. The Archive may contain third-party or external links. We have no control over or responsibility for the content or practices of any third-party websites.

  3. General Use
    1. You may not redistribute any content from The Archive without written permission from the contentís owner.
    2. You may not use The Archive or its content for any commercial use.
    3. You may not use any automated systems which access The Archive more frequently than a human using a conventional web browser. An exception to this provision is granted to search engine indexers.
    4. The Archive reserves the right to discontinue any aspect of the website at any time. We will endeavour to give notice of such changes, but cannot guarantee a given time frame between such notice and the change to the site.

  4. Accounts
    1. You may never access the account of another person on The Archive without their permission. You are responsible for all activity performed under your account. You are responsible for keeping your account secure; we recommend using a complex password. You must notify the staff immediately if you become aware of any type of security breach or unauthorized account use.
    2. The Archive is not liable for any losses that result from unauthorized use of your account.
    3. The Archive reserves the right to terminate your account if you are found to be an infringer (see section 6c).

  5. Content
    1. All content of The Archive, excepting user-submitted content, is the property of The Archive, the designers of the skins used on The Archive or efiction.org.
    2. All user-submitted content is the property of its owner.
    3. In your use of The Archive, you may be exposed to user-submitted content that is inaccurate, offensive, or objectionable. The Archive is not responsible for any user-submitted content, and you acknowledge the risk of harm or damage from accessing user-submitted content rests solely with you.

  6. Ownership
    1. You are responsible for and retain ownership of all content you submit to The Archive, including but not limited to stories, reviews, and forum posts.
    2. You grant The Archive a worldwide, non-exclusive, royalty-free license to reproduce, distribute, and display your user-submitted content. You grant users of The Archive a non-exclusive license to access your user-submitted content through this website.
    3. You agree that you are the owner of or have the consent of the owner of the material you submit to The Archive.
    4. The Archive is not responsible for and does not endorse any user-submitted content or opinions, advice, or recommendations contained therein, and expressly disclaims any and all liability in connection with user-submitted content.
    5. The Archive will remove any content if properly notified that said content infringes on intellectual property rights, and reserves the right to remove any content without prior notice (see section 7).
    6. The Archive reserves the right to remove any content at any time without prior notice at its sole discretion.

  7. Copyright Policy
  8. To file a copyright infringement notification with The Archive, contact a staff member with the following information:
    1. A statement confirming you have located content in The Archive which you believe infringes your copyright.
    2. Which country your copyright applies to.
    3. The title of the content and the full URL to its page in The Archive.
    4. An explanation of what way the content infringes your copyright.
    5. An identification of the copyright work which you own the rights in which you believe has been infringed. If it is available online, provide a link to it.
    6. Contact information which we may use to reach you (email address is preferred).
    7. Contact information which we may provide to the submitter of the content in question, so that they may contact you directly to resolve your complaint (email address is preferred).
    8. h. Your signature; a scanned physical signature or valid digital signature is acceptable.
    9. Note that the above information may be shared with the submitter of the content in question.

  9. Disclaimers
    1. The Archive and its staff assume no responsibility or liability for any interruption or cessation of transmission to or from this website, or any bugs, viruses, or malware that may be transmitted through this website by a third party.
    2. The Archive and its staff assume no responsibility or liability for any unauthorized access to our servers or databases, or any personal information stored therein.
    3. The Archive and its staff assume no responsibility or liability for any personal injury, property, bodily, moral, or material damage of any nature resulting from your use of this website.
    4. You agree to defend, indemnify, and hold harmless The Archive and its staff from and against any and all claims, liabilities, and expenses arising from your use of and access to this website, your violation of any term in these Terms of Service, your violation of any third-party right, or any claim that user-submitted content caused damage to a third-party.

  10. Locality
    1. The Archive shall be deemed solely based in Ontario, Canada.
    2. The Archive is a passive website that does not give rise to personal jurisdiction over this website in any other jurisdiction.
    3. Unless prohibited by local law, these terms of service shall be governed by the internal substantive laws of Canada and the Province of Ontario, without respect to its conflict of laws principles.
    4. Unless prohibited by local law, any claim or dispute between you and The Archive shall be decided exclusively by a court of competent jurisdiction located in Carleton County, Ontario, Canada.
    5. These terms of service, along with any other legal notices available on this website, shall constitute the entire agreement between you and The Archive.
    6. If any provision of these terms of service is deemed invalid by a court of competent jurisdiction, the invalidity of said provision shall not affect the validity of remaining provisions, which shall remain in full force and effect.
    7. You and The Archive agree that any cause of action arising out of or relating to this website must commence within one (1) year after the cause of action occurs, otherwise such cause of action is permanently barred.
